Notes - They were all found guilty on 14/11/97 of interfering with a badger sett and causing unnecessary suffering to a fox. Young was also found guilty of cruelty to his terrier. Stockport magistrates heard over four days how the three were spotted by a woman walking her dog at Ladybrook Valley near Bramhall, Cheshire last February. In court a vet told how he had examined a fox that was found at the scene. It was still warm, had ‘pretty horrendous injuries’ and had bled to death. The court also heard how a greyhound and two terriers were injured, and one of the terriers had such serious injuries that it required three operations to repair the damage to the lower jaw. The three said in court how they had travelled to Stockport to hunt foxes because there were none in Merseyside (yeah right!!!). Taplin also told the court that they would not have dug at the sett if they believed badgers were inside. He also disagreed that the fox had been savaged by the dogs. “What do you think they did? Give it a kiss?” asked the prosecution. Taplin also stated it was a duty to kill foxes “because they are vermin”. All three were sentenced to over 200 hours community service and ordered to pay £200 costs each. Young also had to forfeit his terrier and was banned from keeping dogs for two years.

Notes - Two men found guilty of digging for a badger have been jailed for two months. Lee Robert Burton and Richard Alan Atkins were found guilty on 23/3/99 of digging for a badger after a five-day trial at Coalville magistrates. Police were called and after a chase Burton and Atkins were caught. Both men refused to give their names and Burton threatened an officer with a spade he was carrying. Three dogs were also found on the site they all had scratches on their faces. Other equipment such as a ferret finder, shovels and knives were also recovered nearby. A dead badger was found at the scene and the body was still warm. When they were taken to their new home there was a concrete badger on the front garden which all three dogs immediately attacked. Both men were sentenced to two months in prison. Magistrates ordered all equipment recovered by police to be destroyed and disqualified both men from owning a dog for three years. The three dogs had since been found new homes by the police.

Notes - All three were freed after charges of cruelly treating and causing unnecessary suffering to three terriers were dismissed. They were arrested on 9/10/95 at Dublin's North Wall ferry terminal after a tip-off. Judge Desmond Hogan ruled the charges had been incorrectly brought, as they did not specify where the offence took place. "As far as I am concerned they could have taken place on the moon" he said. Three dogs with horrific injuries had to be put down "on humane grounds" one had its lower jaw torn and this had become infected; another was blind; while a number had pus coming from their mouths, as well as deep lacerations to the face. Four surviving dogs, which included a six week old pup, were moved to a secret location.

Notes - They were both found guilty of cruelty to a fox. The fox was held up by its tail by Trevor Barry while five dogs (three terriers and two Lurchers) savaged it, this lasted for ten minutes. After the dogs tired he picked up a branch and clubbed the fox to death. Trevor Barry said he has been catching foxes for 25 years and selling their skins to a fur company, claimed there was no mark on the fox except a lump on its head where he hit it. Trevor Barry also has a conviction for badger dogging offences in the Forest of Dean 2/7/88.

Mr Glyn Powell of the hunt said the allegations were "totally and absolutely not true".

Notes - The court heard how a local had visited the sett in January 1996 while out walking one evening and noticed a van parked nearby with cages and spades in the back. Dog noises could be heard coming from the sett and he also noticed the top had been disturbed. The police were then called. When the police arrived they saw three men walking towards a wood. Later on Bingham approached a PC at the scene and said he was looking for his dog. Michael Wilson, defending, said Bingham had been out chasing foxes (there goes that old excuse again) with some friends when his dog had got trapped down a hole. He said Bingham did not know it was a badger sett and added “It was done unwittingly and he had full co-operated with the police”. However, examination of the sett later had showed one entrance had been enlarged while two others had been blocked by lumps of concrete. A terrier that was found nearby after the incident had various wounds and scars in the nasal area. It is now in a safe RSPCA home. Bingham was fined £1,000 and ordered to pay £470 costs, banned from keeping dogs for 5 years and had all his equipment, including nets and tracking devices confiscated.

They said they were after foxes and did not realise that a badger was in the hole.

Notes - Two men found guilty of digging for a badger in farm land near Ibstock have been jailed for two months. Lee Robert Burton and Richard Alan Atkins were found guilty on 23/3/99 of digging for a badger after a five-day trial at Coalville magistrates. The pair were spotted in a field at Ibstock. Police were called and after a chase Burton and Atkins were caught. Both men refused to give their names and Burton threatened an officer with a spade he was carrying. Three dogs were also found on the site they all had scratches on their faces. Other equipment such as a ferret finder, shovels and knives were also recovered nearby. A dead badger was found at the scene and the body was still warm. When they were taken to their new home there was a concrete badger on the front garden which all three dogs immediately attacked. Both men were sentenced to two months in prison. Magistrates ordered all equipment recovered by police to be destroyed and disqualified both men from owning a dog for three years. The three dogs had since been found new homes by the police.

Notes - They all admitted interfering with the set of a badger and were described as “blackguards” by a judge at Trim District Court on 25/4/97. Eventually one of the men, Peter Maher was remanded in custody for a seven days. The court heard he had given a false name and address to a wildlife ranger who came across the men. The others were fined. Maher, along with John Casey (32) and Patrick Mulligan jnr (28) were charged with entering lands without the owner's permission on 25/2/96. Casey and Mulligan were told they must pay £100 witness expenses each in addition to fines of £150 and £100 respectively. The judge also disqualified Casey from driving for 12 months for using his car in connection with the offence. The three defendants also admitted interfering with/destroying the breeding place of a protected wild animal and carrying a spade and shovel capable of being used for the hunting of a wild bird or animal. The judge said they had dug 1.3 meters deep into the badger set and "are blackguards”. The badger is a protected animal, this is a well-known set in the area and they deliberately had two dogs and another dog in the boot. If a badger catches you he won't let go. It is his only defence. It is disgusting." He remanded Maher in custody for one week to appear again in Trim District Court at a later date. Recognisance was set in the event of an appeal.

Notes - Banbury magistrates took only one hour to find them both guilty and gave them 60 day sentences for attempting to take badgers, sending a dog into a badger sett and damaging a sett in August 1996. During the trial which lasted two days the court heard how the pair were caught armed with spades at a badger sett in August 1996. They both claimed, wait for it, that they were trying to trap foxes and rabbits and their dogs had entered a badger sett by accident. When police raided Clark’s home they found his living room filled with badger and fox trophies and gin traps were mounted on the walls. He also had dozens of books on bloodsports and hunting and 50 videos containing footage of rabbits and foxes being trapped and killed.. Clark and Underhill claimed they were digging into the sett to rescue their terrier, which had run into the badger sett. Following an appeal at Oxford Crown Court on 16/1/98 the judge ordered the men serve the remaining time of their original sentences, and gave them 30 days each on the other 2 charges, to run concurrently with their longer sentence. Frederick Smalley was charged with interfering with a badger sett by destroying it on his farm between September 10 and October 5 1996. He was due to be tried separately, but sadly I don’t know the outcome of his trial.

Notes - The South Lakes Badger Protection group called in the RSPCA when he found dead badger carcasses and illegal locking snares on the Holker Hall estate of Lord Cavendish, near Cark-in-Cartmel. A covert operation was set up by the RSPB in response finding a cage trap. It ultimately led to the discovery of two dead badgers though fifteen were believed to have been killed in the preliminary investigation in 1998. One was found hanging over the edge of a limestone outcrop where it had asphyxiated after dragging a snare for 30 yards. Badger bones and skulls were scattered around the area and a dead buzzard was found hidden in a hole. On 11/6/99 John Drummond who is the Head Gamekeeper for the estate was found guilty on 46 out of 65 charges under the Protection of Badgers Act and the Wildlife and Countryside Acts. Drummond was found guilty of willfully killing two badgers, willfully taking one badger and cruelly mistreating all three. On 12/7/99 Drummond was jailed for three months.

During a search of Fellows house in October 1995 the RSPCA found a stuffed badger and three wildlife traps. Fellows was defended by John Lishman, David McQueen defended Rogers and Richard Lloyd defended Richards. They were all banned from keeping dogs for 10 years. Following an appeal at Shrewsbury Crown Court on 14/9/96, his ban on dogs was lowered to 3 years.

Paul Sheridan (43) of Johnson Fold Avenue, Johnson Fold, and Shaun Harwood (34) of Selkirk Avenue, Astley Bridge, had both been found guilty of badger baiting by Blackburn magistrates and on 21/8/99 they were each sentenced to 150 hours community service and ordered to pay £150 costs. When they were discovered Sheridan had three terriers with him and claimed one of the dogs had run off and chased a fox down the sett, then become trapped underground. Magistrates found the men guilty of digging for a badger, damaging and obstructing a badger sett and causing a dog to enter a sett.

Notes - Gary Lee Haslam was convicted of digging for badgers but has escaped a jail sentence. Haslam was also found guilty of cruelty to his dog, which suffered nasty facial injuries, was given 100 hours community service and put on a four-month curfew. On 7/2/00 Burnley magistrates banned Haslam from keeping a dog for five years and told to pay £1,200 in costs and his dog was forfeited. Haslam must now stay in between 9.30pm and 6am for the next four months and wear ankle and wrist bracelets. The court heard how Haslam had been seen by police coming out of a wood wearing camouflage clothing and his dog was bleeding from the mouth and eye. Haslam said his terrier had disappeared into a hole and he had dug her out. While digging, he claimed, he saw a fox vault from the hole followed by the dog. Officers later found the defendant's spade and iron bar near to an active badger sett. Haslam said he had never seen a badger. The court also heard that Haslam has had working dogs virtually all his life.

Notes - Caught February 1995. Hattersley admitted cruelty to a badger and three charges of putting his dogs at risk. Whilst they were digging for badgers a local spotted them and phoned the police, When they realised they were being watched they both ran off, but were arrested nearby. A badger cub was found dead at the sett and five injured terriers were also recovered. Mark Anderson defended Bradley and Steven Cooper defended Hattersley. They said they were after foxes and did not realise that a badger was in the hole.

Roberts was also fined an extra £70 for having no tax disc and no M.O.T. on his car. Roberts Also has another conviction 11/5/87.
